Kirby was one of three men executed by electrocution at the South Carolina penitentiary on June 10, 1922. The Yorkville Enquirer reported that the execution was carried out with few witnesses present. Earlier dates set for the execution had been stayed by appeals. Petitions for commutation were made in the weeks before, and according to the paper the governor did not act on them.
